DMCA Policy

William And Mary Taylor Appalachian ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the William And Mary Taylor Appalachian service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.

This policy describes the information that should be present in a DMCA Notice and Counter-Notice, and outlines the procedures for submitting such notices to William And Mary Taylor Appalachian.

Filing a DMCA Notice of Alleged Infringement

  4. Include both of the following statements in the body of the Notice:
    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.

Deliver this Notice, with all items completed, to our Designated Copyright Agent via the contact methods provided on our Contact Us page. Please clearly mark your communication "DMCA Notice" to ensure proper routing.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a Counter-Notification with us by submitting the following information to our Designated Copyright Agent. Upon receipt of a valid Counter-Notification, we may restore the removed material or cease disabling it. However, we will not restore or cease disabling the material if the party who submitted the original DMCA Notice notifies us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our Site.

  • Identify the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Provide your full contact information, including your mailing address, telephone number, and, if available, email address.
  • Include the following statement in the body of the Notice: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which William And Mary Taylor Appalachian may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
  • Include the following statement in the body of the Notice: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Provide your full legal name and your electronic or physical signature.
